NEW REFERENCE VALUE <\/h2>\t\t\t\t<\/div>\n\t\t\t\t

The Treasury, through the General Directorate of Cadastre, determines with effect from 1 January 2022<\/strong>, a new value, apart from the cadastral value, called “reference value”.<\/p>

In 2022, it only affects residential real estate and rustic real estate without construction<\/strong>. It is expected that in 2022, with the October publication, the rest of the properties will be progressively integrated to this new system. We may find that even if it is one of the properties listed above, the reference value exists or does not exist in a given property. And both situations have important fiscal effects.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

What is the cadastral reference value?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

The so-called reference value of the cadastre in law 11\/2021 is defined as the value objectively determined for each property from the data in the Cadastre, which corresponds to the most probable price<\/strong> for which a property could be sold between independent and unencumbered parties. This new law modifies the Cadastre Law, adapting the regulation of the Cadastre and adding that this reference value will be limited to the market value<\/strong>, which may not be exceeded. To this end, a reduction factor will be applied in its determination.<\/p>

Following the approval of Law 11\/2021 of 9 July on measures to prevent and combat Tax Fraud, this new reference value is the minimum taxable base for Transfer Tax and Stamp Duty (ITP and AJD) as well as Inheritance and Gift Tax (ISD). In the case of Wealth Tax, the reference value will affect properties acquired from 2022 onwards, but not pre-existing assets.<\/p>

This new value does not modify<\/strong> either the Real Estate Tax (IBI) or the tax on the increase in the value of urban land (IIVTNU or capital gains tax).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

Para el c\u00e1lculo del valor de referencia, los datos descriptivos de cada inmueble urbano a considerar ser\u00e1n los obrantes en el Catastro Inmobiliario, que gozar\u00e1n de la presunci\u00f3n de certeza establecido en la normativa. Ese c\u00e1lculo se realizar\u00e1 con arreglo a las caracter\u00edsticas constructivas y de localizaci\u00f3n en el cierre de cada ejercicio.<\/p>

Cualquier m\u00ednimo error por parte de la administraci\u00f3n entre la realidad f\u00edsica y la imputaci\u00f3n de las caracter\u00edsticas constructivas o en la asignaci\u00f3n del \u00e1mbito territorial homog\u00e9neo de valoraci\u00f3n seg\u00fan los usos que correspondan con las actividades definidas por el Catastro, conllevar\u00e1 que el valor de referencia no sea el que le corresponde a la realidad inmobiliaria de su patrimonio y puede suponer incrementos considerables en la liquidaci\u00f3n de impuestos.<\/p>

Recomendamos por tanto que, si se tiene previsto realizar una transmisi\u00f3n, no se espere hasta el momento de la firma en notar\u00eda. Haciendo un poco de planificaci\u00f3n, el titular catastral puede y debe comprobar que el valor de referencia de su inmueble es el adecuado<\/strong> y, en caso contrario, instar a su rectificaci\u00f3n, antes de tener que dar lugar a liquidar impuestos por un valor incorrecto.<\/p>
